- Send a notice to legal@sharefetti.com or use the form at the bottom of this page.
- Include the event link, which photos or videos, and what work of yours they copy.
- In Canada we forward notices to the uploader under the notice-and-notice system.
- In the US we follow the DMCA: we remove the Content and the uploader can send a counter-notice.
- Accounts that repeatedly infringe are closed.
We respect the work of photographers, videographers, musicians and other creators. If you believe something on Sharefetti uses your work without permission, tell us using the steps below. This page covers copyright. If you want a photo of yourself or your child removed for privacy reasons, that’s a different request, and it’s usually faster (see section 7).
1. What to include in a notice
- your name, mailing address, phone number and email;
- a description of the copyrighted work you own (for example, a professional photo or a song);
- the event link and enough detail for us to find the Content, such as which photo or video;
- a statement that you believe in good faith that the use isn’t authorized by the owner, its agent or the law;
- a statement that the information is accurate and, under penalty of perjury, that you are the owner or authorized to act for the owner; and
- your physical or electronic signature.
Notices missing these details may not be valid, and we may ask you for more information before acting.
2. Canada: notice-and-notice
Canada’s Copyright Act uses a “notice-and-notice” system. When we receive a valid notice about Content uploaded from Canada, we forward it to the person who uploaded it, keep records as the Act requires, and tell you that we’ve done so. The Act doesn’t require us to remove the Content, but we may remove or hide it under our Acceptable Use Policy, especially where infringement is clear.
3. United States: DMCA takedown
For users in the United States, we follow the Digital Millennium Copyright Act (DMCA). When we receive a valid notice, we remove or disable the Content promptly, tell the uploader and the Host, and give them a copy of the notice.
Our designated agent for DMCA notices is: [AGENT NAME], Sharefetti, [AGENT ADDRESS], legal@sharefetti.com, [PHONE].
Before launch: register this agent with the US Copyright Office’s DMCA Designated Agent Directory and renew it every three years.
4. Counter-notices
If your Content was removed and you believe it was a mistake or that you had the right to use it, you can send a counter-notice to legal@sharefetti.com with:
- your name, address, phone number and email;
- the Content that was removed and the event it was in;
- a statement, under penalty of perjury, that you believe in good faith it was removed by mistake or misidentification;
- for US counter-notices, your consent to the jurisdiction of the federal court for your address (or, if outside the US, any district where we may be found), and that you’ll accept service from the person who sent the notice; and
- your signature.
We’ll send the counter-notice to the person who complained. Unless they tell us within 10 to 14 business days that they’ve started a court action, we may restore the Content, as long as the event is still within its storage period.
5. Repeat infringers
We close the accounts of Hosts who repeatedly upload or allow infringing Content after being notified, and we may block Guests from uploading to events. Closed accounts aren’t refunded.
6. Photos from professional photographers
Many wedding and event photographers keep the copyright in their images and give couples a licence to share them personally. Uploading them to a private event gallery may be fine under that licence, but showing them on a public slideshow or using them for a business may not be. Check your photographer’s contract.
7. Privacy and likeness requests
Not a copyright issue? If a photo or video shows you or your child and you want it removed, use the privacy request form or ask the Host directly. You don’t need to own the photo to ask.
Send a copyright notice
Fill this in and we’ll email you a copy with a reference number. For a photo of you or your child, use the privacy request form instead.
